Zoom Conditions of Carriage

Zoom Air- India’s Newest Full service computer airlines operates to Multiple capitals in India hubbing over New Delhi, Kolkata.

General

The carriage of a Passenger is subject to Zoom Air regulations relating to the "Conditions of Carriage". Zoom Air shall not be liable for any damages whatsoever arising out of (or) in any way connected with the use of this website (or) for any information, products and services. (Other than carriage by air)

While every effort has been made to ensure provision of correct and up to date information through this website, Zoom Air does not make any warranties (or) shall not be liable for the accuracy of such information. Customers who request for duplicate print-outs of the itinerary at the airport reservation counters will have to pay an additional fee of Rs. 100 per print out (inclusive of service tax and cess, if applicable)

Bookings, Rebooking, Cancellations and Refunds

Bookings

Zoom Air Online Booking system is available only for flights operated by Zoom Air. Reservations can be made for up to Nine Passengers per Booking / PNR. Zoom Air offers electronic tickets for travel and the image of the ticket is saved in the reservation system. An Itinerary receipt issued contains the PNR and the details of reservations. An Itinerary receipt is a valid document to enter the airport and for check-in.

- Zoom Air does not issue open Bookings.
- Zoom Air's Reservations are non-transferrable.
Passengers can make reservations at the following Points of Sale.

A) Zoom Air Website: www.Zoomair.in
B) By contacting the 24/7 Zoom Air Call Centre.
C) Zoom Air Airport Counters.
D) Participating Travel Agencies / Online Travel Portals.

Zoom Air accepts Master and VISA Credit Cards at the Zoom Air call centre; Website and airport offices. Zoom Air accepts Debit Cards of select banks for booking through Website and Airport offices. Payment of online bookings through our website can also be made by Net Banking of select banks securely through the respective banks Internet Banking option. Payment through Internet Booking is subject to authorization from the account holder's bank.
Note: Zoom Air does not accept International Credit Cards.
Passengers should carry the credit card / debit card, or a copy of the credit card / debit card duly signed by the card holder, at the time of check-in. Zoom Air does not accept personal cheques.

Re-bookings

Zoom Air allows rebooking against an existing booking, subject to the following:

A) Rebooking can be done at least two (2) hours prior to scheduled departure, and the applicable rebooking charges shall be INR 2000 per Passenger per Sector on Economy Class.
B) Difference in fares at the time of rebooking (if any) shall be charged.
C) Changes in itinerary/ date of travel are permitted in case of rebooking.
D) Name change is not permitted.

Cancellations

Zoom Air allows cancellation of bookings subject to the following:

a) Cancellations of Booking must be made at least two (2) hours prior to scheduled departure

Cancellation during this period is treated as no show. Only airport taxes are refundable.

Refunds

A) For Bookings made at Airport Counters/ City Ticketing Offices

1) Bookings can be cancelled with Call centre or Airport offices or city ticketing offices & Website only.

2) Passenger will receive a SMS instantly intimating him about the refund amount through a Credit Shell (CS) with password which can be redeemed or used for future travel, with a validity of one year, from the date of said cancellation.

3)CS will be redeemed and paid only on request from concerned.

In case a booking was made by cash, CS generated on cancellation can be redeemed only in cash at airport counter/city ticketing offices.

4) In case a booking was made by Credit/Debit Card, CS generated on cancellation will be redeemed and paid only to the respective Credit/Debit card(s) used at the time of booking, such redemption may take within 10 working Days.

B) For Bookings made through Zoom Air website

1) Bookings can be cancelled through call centre/ Airport offices / Zoom Air website.

3)Passenger will be informed about cancellation by SMS and/or email, instantly.

4) Refunds shall be processed to their respective credit card / debit card / net banking, within 24- 48 hours of said cancellation and may take 10 working days’ time to get credited.

C) For Bookings made through Travel Agents

1)Bookings can be cancelled through respective travel agent / Call centre / Airports.

2) Passenger will be informed about cancellation by SMS and/or email, instantly, thereafter the passengers can contact their travel agent for refund.

D) Refunds against flight cancellation/ delays etc. as provided under clause

Flight Cancellations

  • In order to reduce inconvenience caused to the passengers as a result of the cancellations of the flights on which they are booked to travel, ZOOM AIR should, wherever possible, try to inform the passengers of cancellations of their flights as far in advance as possible of the scheduled time of departure This is subject to the passenger having given, at the time of effecting his/her reservation, relevant contact information e.g. telephone number, fax number, e-mail address etc.
  • For passengers who have not been informed at least three hours in advance about the cancellation of the flight on which they were scheduled to travel, ZOOM AIR shall:
    • Refund the ticket prices in the event they do not wish to travel instead on an alternate or subsequent flight of Zoom Air on another carrier’s flight. If so desired by the passengers, ZOOM AIR shall provide them alternate travel opportunities at no additional cost; and
    • Additionally, provide them facilities at the airport.
  • No financial compensation shall be payable to passengers who have not provided adequate contact information at the time of making booking or when the ticket for firm travel on the selected flight is issued. In respect of such passengers, ZOOM AIR will either refund the ticket prices or make reasonable endeavour to make alternate travel arrangements as per the choice of the passengers. Additionally, in respect of such passengers who elect to travel to their destination on an alternate flight, ZOOM AIR shall provide them with reasonable facilities during the period that they are required to wait at the airport for the alternate flights.
  • No such compensation shall be payable to any of the affected passengers in the event:
    • They do not accept the alternate travel arrangements made by Zoom Air.
    • The cancellations occur due to extraordinary circumstances beyond the control of ZOOM AIR, even if all reasonable measures had been taken by ZOOM AIR.
  • Where bookings are made through Zoom Air website, airport counters/ city ticketing offices / call centre and if, the passenger opt for full refund, same will be processed within 24 to 48 hours of said cancellation and may take 10 working days for credit.
  • Where bookings are made through travel agents/ online travel portals and if, the passenger opt for full refund, same will be processed within 24 to 48 hours of said cancellation and credit will be made to travel agent account, Passengers are requested to approach concerned travel agent or travel portal as the case may be.
  • If flight is delay more than 3 hrs, in such cases passenger is entitled for Full Refund.

E) Persons to Whom Refund Will Be Made

Zoom Air shall make refund either to the person named in the Booking, or to the person who has paid for the Booking, upon presentation of satisfactory proof e.g. CS number with a password as sent by Zoom Air by SMS / E-mail shall only be considered for refund.

F) Right to Refuse Refund

Zoom Air has a right to refuse refund in case validity of CS has lapsed.

Currency

All refunds will be made in INR, after deducting any applicable fee or charges.

Fares in INR Fares

- All Zoom Air fares are quoted in Indian Rupees only.
- Certain fares may have conditions which limit or exclude the Passengers' right to cancel Bookings.
- Fares are subject to change, without notice.

Taxes, Fees and Other Charges

Taxes, Fees and other charges are collected as applicable, at the time of booking. Any change in the rates / amounts of taxes, duties and other charges after the date of booking will become payable to Zoom Air, said difference in Taxes / Fees / other charges, as applicable will be collected at the airports on the day of departure.

The total fare amount charged by Zoom Air includes: basic fare, surcharges payable to Zoom Air, airport charges and taxes imposed by the government / airports. These fare components may undergo a change at any time without notice. Currently Zoom Air's surcharges include:
- Passenger Service Fee
- Swachh Bharat Cess (w.e.f 15th Nov’15)
- Krishi Kalyan Cess (w.e.f 01st Jun’16)

Note: A Non-Refundable convenience fee of INR 150 per passenger per segment will be charged for all transaction made from www.zoomair.in, Reservations & Airport ticketing counter (ATO/CTO).
For passengers who request for duplicate print-outs of their ticket at the airport reservation counter, an additional fee of Rs. 100 per ticket will be applicable.

Sharing of contact information at time of booking
Zoom Air requests that at the point of booking, the passengers should provide it with a contact number (valid mobile number) which can be reached in case of any contingency. Zoom Air shall not be liable, under any circumstances, in case contact number so provided is either invalid or not reachable.

Seating
Zoom Air offers allotment of seats for travel at airport check-in counters/ through its website. Due to Operational / Safety / Security reasons the seats so allotted can be re-assigned re-allotted at any time not after boarding the aircraft.
Note: Zoom Air charges allotment of exclusively front row seats @ Rs 500

Check-in, Boarding and Go-Show
Passengers will be accepted for transportation only when a valid itinerary issued in accordance with Zoom Air. All Passengers, including children, are advised to present valid photo identification and for Infants Valid Birth Certificates at the time of check-in. Passengers should carry the credit card / debit card, or a copy of the credit card / debit card duly signed by the card holder, at the time of check-in.

The following are considered as valid photo identification:
- Valid passport
- Valid driving license
- Election photo ID
- PAN card issued by the Income Tax Department
- Photo ID issued by the employer (where the employer is a government entity or a reputed private organization)
- In case of children, their school photo ID cards or any other photo ID
- For infants, their valid birth certificate.
Passengers who cannot provide sufficient identification will be denied boarding. Passengers are advised to report for Check-in at least 2 hours prior to the schedule departure. Zoom Air reserves the right to refuse acceptance of a Passengers who do not adhere to check-in timings. Check-in closes 45 minutes prior to the scheduled departure of the flight. The Booking would be considered a "No Show" and the Passenger shall be eligible for refund of Taxes only. Passenger check-in at our Website begins 24 hours and closes 3 hours prior to the scheduled departure.

Boarding
The boarding gate will be closed 20 minutes prior to the departure. The passengers are required to be present at the boarding gate not later than the time specified by Zoom Air when they check in, failing which they will be considered as "Gate No Show".

Go-Show
The ticketing for particular flight closes one hour prior to the schedule departure.

Failure to Comply

Zoom Air shall not be liable for any loss or expenditure incurred by the passenger due to the failure of the passenger to comply with the check-in procedures.

Right to Refuse Carriage

Zoom Air may refuse carriage of the Passenger or the Passenger's Baggage if, in the exercise of our reasonable discretion, we determine that:
- Such action is necessary in order to comply with any applicable laws, Regulations, or orders of any state or country to be flown from, into or over;
Or
- The conduct, age, or mental or physical state of the passenger is such as to: Require special assistance of Carrier,
Or
- cause discomfort or make himself or herself objectionable to other passengers,

- Involve any hazard or risk to himself or herself or to other persons or to property;
Or
- Such action is necessary because the passenger has failed to observe the instructions of Carrier;
Or
- The passenger has refused to submit to a security check;
Or
- The applicable fare or any charges or taxes payable have not been paid, or credit arrangements agreed between Carrier and the passenger (or the person paying for the ticket) have not been complied with;
Or
- The passenger does not appear to be properly documented;
Or
- The ticket presented by the passenger: has been acquired unlawfully or has been purchased from an entity other than the issuing Carrier or its authorized Agent,
Or
- The person presenting the ticket cannot prove that he or she is the person named in the "Name of Passenger" box, and Carrier reserves the right to retain such tickets.
Passengers upon request not presenting, credit card / debit card, or a copy of the credit card / debit card duly signed by the card holder, at the time of check-in

Special Assistance

Zoom Air offers special services for:
- Infants
- Minors
- Pregnant women
- Wheelchair-bound Passengers
- Crutches / braces / other prosthetic devices
- Visually impaired Passengers
- Senior Citizen
Such Passengers are required to mention the requirement of these services at the time of making the Booking. Zoom Air reserves the right to deny these services to Passengers if not requested in advance.

Infants
New born babies aged between 7 days to 2 years are considered as “Infants”, and will not be provided separate seat and should be seated on an adult's lap. Infants not occupying a seat are subject to a fee of INR 1,200 per Sector and are inclusive of all taxes, fees and surcharges. A maximum of one Infant is allowed per adult. No baby / car seats or push chairs are allowed in the aircraft cabin. No extra seats may be booked for Infants and customers accompanying infants are allowed an additional piece of Hand baggage up to 5Kgs. In case hand baggage is found to be overweight at boarding gate a flat rate of INR 250 per kg per sector would be charged towards excess hand baggage.

Unaccompanied Minors (UNMR)
- Unaccompanied minors, aged between 5 -12 years will be accepted for travel under the following conditions, and upon payment of an additional fee of INR 1500 per Sector:
- A parent or guardian is required to complete a signed UMNR form at the point of check-in, at departure airport prior to travel, which must include the name and contact numbers of a parent / guardian, who will meet the unaccompanied minor at the point of arrival;
- Valid photo-ID for both the unaccompanied minor and the parent or guardian is required at the point of check-in;
- The parent or guardian must remain at the airport until the flight has departed.

Pregnant Women
In case of normal pregnancies, expectant mothers till the end of 32 weeks of pregnancy may be permitted to fly on Zoom Air flights provided there are no prior complications. Certificate(s) from the treating obstetrician is required stating the number of weeks the pregnancy has advanced and that the Passenger is fit to travel by air, which shall be for three days only, from date of issue, excluding issue date. Passengers are required to fill an indemnity bond at the airport before the flight.

Wheelchair-bound Passengers
If the Passenger needs wheelchair assistance at the airport, please request Zoom Air at least 24 hours in advance. The inventory is limited to 4 wheelchairs per flight. Zoom Air allows only manual / collapsible wheelchairs on all its flights. Powered wheelchair(s) with a wet cell battery shall not be accepted. If the Passenger wishes to use their own wheelchair at the airport, they are permitted to do so up to the aircraft, whereupon it will be stored in the hold.

Crutches / braces / other prosthetic devices
Passengers are allowed to use their own crutches, braces and / or other prosthetic devices, and may board with such items as cabin Baggage subject to security clearance, provided the Passengers are dependent on them.

Visually impaired Passengers
Zoom Air would request visually impaired passengers to check-in early for their flight (approximately 2 hours before flight departure) for a hassle free check-in. If assistance is required within the airport, please identify your needs at check-in or at the time of booking. Zoom Air will be able to extend a meet and assist service to the passenger to help in boarding, deplaning and also during flight connections.

Senior Citizens
Zoom Air shall provide all required facilities for senior citizens while traveling for their smooth passage at Airport.

Currently Zoom Air does not have provisions for accommodating pets in passenger cabin.

Baggage

Non-Fit Cabin baggage (Check-in /Hand Baggage)
Zoom Air reserves the right to refuse any cabin baggage which exceeds Baggage dimensions.
Zoom Air allows the following Cabin/Hand baggage dimensions on all routes.
Length – 34cms, Width -10cms, Height - 20cm
- Contours are available at all Airports to check the dimensions. If it exceeds these specifications due to space in the overhead bin, it shall be removed and loaded the same baggage in the cargo hold as per safety regulations.
- Items which are likely to endanger the aircraft or persons or property on board the aircraft such as those specified in the International Civil Aviation Organization (ICAO)

As per our airline policy, we do not carry any dangerous goods in our aircrafts.
- Items, the carriage of which is prohibited by applicable laws, regulations or orders;
- Compressed gasses: deeply refrigerated, flammable, non-flammable and poisonous such as butane oxygen, liquid nitrogen,aqualung cylinders and compressed gas cylinders;
- Corrosives items such as acids, alkalis, mercury and wet cell batteries and apparatus containing mercury;
- Explosives, munitions, fireworks and flares, ammunition including blank cartridges handguns, fireworks, pistol caps, swords, knives and similar items;
- Flammable liquids and solids such as lighter refills, lighter fuel, matches, paints, thinners, fire-lighters, lighters that need inverting before ignition, matches (these may be carried on the person), radioactive material, briefcases and attaché case with installed alarm devices;
- Oxidizing materials such as bleaching powder and peroxides;
- Poisons and infectious substances such as insecticides, weed-killers and live virus materials;
- Fish (including, sea food), animals, birds, insects in any form, whether live and/or dead and/or frozen and/or dried;
- Anything that possesses and/or is capable of possessing and/or emitting a conspicuous and/or offensive odour;
- Other dangerous articles such as magnetized materials, offensive or irritating materials;
- Human or animal remains;
- Live or dead animals;
- Items, which, in our reasonable opinion, are unsuitable for carriage by reason of their weight, shape, size or character.

Checked Baggage
- Zoom Air allows free Checked Baggage up to 15kgs per adult and child in Economy (any Passenger above 2 yrs of age).
At the Airport: Passenger(s) carrying more than the baggage allowance as mentioned above will be charged at rate of INR 250 per kg (inclusive of taxes).
A flat rate of INR 250 per kg or part thereof per Sector would be charged towards excess Baggage. Checked Baggage must have the Passenger's name or other personal identification affixed to it.
- Zoom Air does not permit the carriage of a Golf Kit as baggage.
- Checked Baggage will, whenever possible, be carried on the same aircraft as the Passenger, unless Zoom Air decides for safety, security or operational reasons, to carry it on an alternative flight. If the Checked Baggage is carried on a subsequent flight, Zoom Air will deliver it to the Passenger.
- Situations may arise where transfer of cabin baggage to the baggage hold of the aircraft before take-off will be necessitated in such cases the baggage will be tagged with an appropriate Limited Release Tag (LRT) and transferred to the hold. The baggage can be retrieved from the conveyer belts as done in the case of checked - in baggage.
Note: Zoom Air does not entertain International Connecting Flight Baggage policy.

Valuable Items
Valuable and Fragile goods include, without limitation, Currency, Jewellery, silverware, electronic devices, medicines, perishable goods, computers, cameras, video equipment, negotiable papers, securities and/or other valuables, passports and other identification documents, title deeds, artefacts, manuscripts and the like. Passengers are advised not to check in Valuable and Fragile Goods as Baggage.
If such items are checked in as Baggage, Passengers agree that they send for carriage of such items, at their own risk. Zoom Air shall not accept any responsibility for such carriage.

Hand Baggage policy
Passengers may carry a maximum of one piece of Hand Baggage including laptop or ladies hand bags, of weight not exceeding 5 kg and not exceeding the following measurements in size:
Length – 34cms, Width -10cms, Height - 20cm
Contours are available at all Airports to check the dimensions. If it exceeds these specifications due to space in the overhead bin, it will be necessary to remove and load the same in the baggage hold as per safety regulations. Hand baggage of excessive weight or size, or of an offensive nature, will not be permitted on board. Subject to the prevalent applicable local laws and regulations, Passengers may take liquids on board in their Hand Baggage, subject to screening and security checks, and provided they meet the following restrictions:
- The liquid is in a container with a maximum volume of 100 ml.
- All liquid containers meeting the maximum volume of 100 ml each can be fitted comfortably into a transparent, re- sealable 1 litre plastic bag.

Right to Refuse Carriage of baggage
Zoom Air may refuse carriage as baggage of items described in Un-Acceptable Baggage.
Zoom Air may refuse to carry as baggage any item because of its size, shape, weight or character, unless advance arrangements for its carriage have been made with Zoom Air. Zoom Air may refuse to accept baggage as checked baggage unless it is properly packed in suitcases or other suitable containers to ensure safe carriage with ordinary care in handling.

Right to Search
For reasons of safety and security, Zoom Air may request the passenger to permit a search to be made of his or her person and his or her baggage, and may search or have searched the passenger's baggage in his or her absence, if the passenger is not available, for the purpose of determining whether he or she is in possession of or whether his or her baggage contains any item described in dangerous goods or any arms or ammunitions which have not been presented to Carrier in accordance with dangerous goods. If the passenger is unwilling to comply with such request Carrier may refuse to carry the passenger and / or baggage.

Items Removed by Airport Security Personnel
Zoom Air will not be responsible for, or have any liability in respect of, articles removed from the Passenger's Baggage by airport security personnel acting in accordance with any applicable laws and/or regulations.

Security Screening

Screening
As required by applicable law, all Passengers will be subjected to a security screening prior to boarding the aircraft.
Printed travel Itineraries will be checked at the time of entering the terminal building. Checked Baggage will be screened through an X-ray machine before check-in. Random physical checks are also carried out for Checked Baggage in addition to X-ray screening. As per security regulations, Passengers will be required to undergo personal frisking & their Hand Baggage X-rayed before entering the pre-boarding sterile area.
Checked Baggage reconciliation is carried out through an internal matching system. Wherever it is not possible to have the Baggage reconciliation, the physical identification of the Checked Baggage by the Passengers will be carried out. Unidentified Baggage will not be loaded on to the aircraft.
A secondary security check may also be carried out either near the boarding gate / step ladder before embarkation as and when stipulated by BCAS.

General
According to security regulations, Passengers are advised: a) Not to accept any packets from unknown persons;
b) Not to leave Baggage unobserved at any time, especially within airport area;
c) Unattended Baggage may be removed by airport security staff as object of suspicion;
d) To declare before Baggage screening or check-in if carrying any arms or explosive substance. Concealment is an offence under Aircraft Act and Rules;
e) To carry only one piece of Cabin Baggage, the sum of the three dimensions (length, breadth and height) of which should not exceed 64 cm
f) Battery cells / Dry cells carried in the Cabin Baggage or in any electrical/ electronic items are liable to be removed and Zoom Air may not be in a position to return such removed items same at the Passengers' destination. Zoom Air recommends that such items be carried in Checked Baggage;
g) All Baggage should be clearly labelled with the Passenger's name, address and contact details.

Schedule, Delay and / or Cancellation of Flights

Schedule.
Zoom Air will endeavour to adhere to published schedules in effect on the date of travel. However, the schedules are subject to change without prior notice and Zoom Air will not be liable for any loss incurred by passengers as a result of such changes including but not limited to missing a connecting flight, whether domestic or international, loss of time, business loss etc. Zoom Air will not be liable for any error or omission in publications of schedules, or in statements or representations made by employees, agents, or representatives of Zoom Air, as to the dates or times of departure or arrival, or as to the operation of any flight.

Cancellation, Changes of Schedule etc.
At any time after a Booking has been made, we may change our schedules and/or cancel, terminate, divert, postpone, reschedule or delay any flight if it is caused by an event(s) of force majeure i.e. extraordinary circumstance(s) beyond the control of the airline, the impact of which lead to said delay, cancellation etc., and which could not have been avoided even if all reasonable measures had been taken by the airline. Such extraordinary circumstances may include without limitations, political instability, natural disaster, weather conditions, air traffic control, mechanical failure, acts of terrorism, acts of nature,, riots, wars, hostilities, disturbances, governmental regulations, orders, demands or requirements, shortages of critical manpower, parts or materials, labour unrest, civil war, insurrection, , strikes and labour disputes causing cessation, slowdown or interruption of work or any other factors that are beyond the control of the airline. If Zoom Air flight is cancelled, rescheduled or delayed for more than two hours (depending on the length of the journey), a Passenger shall have the right to choose a refund; or a credit for future travel on Zoom Air flights; or re-booking into an alternative Zoom Air flight at no additional cost subject to availability as per the rules and regulations of Zoom Air / government regulations. In the special case in which a subsequent portion of an Zoom Air flight is cancelled while a Passenger is already in transit, such Passenger shall have the right to choose to remain at the transit station and to be re-booked onto an alternative Zoom Air flight to the final destination at no additional cost subject to availability; or to remain at the transit station and accept a partial refund for the portion of the flight not completed; or to return to the point of origin and receive a refund; or a credit for future travel on Zoom Air; or re-booking into an alternative Zoom Air flight at no additional cost subject to availability. We strongly recommend all Passengers to provide correct phone and email address, to enable us to inform of flight delays or cancellations in unforeseen cases. Passengers who have not provided valid contact information at the time of Booking may not be entitled for any compensation. Zoom Air shall not be liable, under any circumstances, in case contact number so provided is either invalid or not reachable.

Denied Boarding.
As a policy, Zoom Air does not overbook its flight. However , in case of overbooked situation arising due to unavoidable situations (e.g. clubbing of flights etc.) resulting in Passengers being denied boarding against their will, Zoom Air shall provide a full refund of the air Booking or shift the Passenger's reservation to the next available flight. Zoom Air reserves the right to deny boarding to any Passenger who is under the influence of alcohol or drugs, for health, safety or security reasons or in the absence of adequate travel documents and no compensation as referred above shall be payable in such cases.

On board the Aircraft Conduct.
If, in Zoom Air's reasonable opinion, a Passenger conducts himself aboard the aircraft so as to endanger the aircraft or any person or property on board, or obstruct the crew in the performance of their duties, or fail to comply with any instructions of the crew, including but not limited to those with respect to smoking, alcohol or drug consumption, or behave in a manner which causes discomfort, inconvenience, damage or injury to other Passengers or the crew, Zoom Air may take such measures as it deems reasonably necessary to prevent continuation of such conduct, including restraint. Such Passenger may be disembarked and refused onward carriage at any point, and may be prosecuted for offences committed on board the aircraft and shall not be eligible for any compensation, whatsoever

Payment of Diversion Costs.
If, as a result of conduct by a Passenger of the sort mentioned above Zoom Air decides, in the exercise of Zoom Air's reasonable discretion, to divert the aircraft for the purpose of offloading that Passenger, the Passenger must pay all costs resulting from that diversion

Use of Electronic Devices Prohibited

For safety reasons, Zoom Air may forbid or limit operation aboard the aircraft of electronic equipment, including, but not limited to as per the government regulations prevailing at that time, cellular telephones, laptop computers, portable recorders, portable radios, CD players, electronic games or transmitting devices, including radio controlled toys and walkie-talkies. Operation of hearing aids and heart pacemakers is permitted.

No Smoking

As a policy, Zoom Air does not overbook its flight. However , in case of overbooked situation arising due to unavoidable situations (e.g. clubbing of flights etc.) resulting in Passengers being denied boarding against their will, Zoom Air shall provide a full refund of the air Booking or shift the Passenger's reservation to the next available flight. Zoom Air reserves the right to deny boarding to any Passenger who is under the influence of alcohol or drugs, for health, safety or security reasons or in the absence of adequate travel documents and no compensation as referred above shall be payable in such cases.

General

Zoom Air offers an enhanced selection (Veg/N. Veg) of food and beverages on board Complimentary on all Zoom Air flights. Zoom Air does not allow Passengers to bring food items on board. Allowed food items include cold snacks, non-alcoholic drinks, snack bars and biscuits. For the convenience of our Passengers, messy, oily or strong smelling food items are not allowed on board. Passengers seated near an emergency exit will be briefed by the crew regarding emergency procedures and are requested to pay special attention to these requirements. Please note that able bodied passengers aged above 15 years and below 60 years will be allocated emergency exit rows.

Liability for Damage:

Passenger Liability.

1. In the event of death or any other bodily injury suffered by a passenger during the course of carriage by air, Zoom Air’s liability will be governed by the relevant provisions of the Carriage by Air Act, 1972 and any modifications etc. as notified by the Ministry of Civil Aviation, Government of India, and as amended from time to time and the rules contained thereunder and in no event shall the liability amounts under this scenario exceed the amount of Rs. 20,00,000/-.

2. Notwithstanding above provisions, if Zoom Air proves that the damage was caused by, or contributed to by, the negligence of the injured or deceased / injured Passenger, Zoom Air may be exonerated wholly or partly from its liability.

3. Zoom Air is not responsible for any illness, injury or disability, including death, attributable to the Passenger's physical condition or for the aggravation of such condition.

4. The contract of carriage, including these Terms & Conditions and exclusions or limits of liability, applies to our Travel Partners, employees and representatives to the same extent as it and they apply to Zoom Air. The total amount recoverable from Zoom Air and from such Travel Partners, employees, representatives and persons shall not exceed the amount of Zoom Air's own liability, if any.

Baggage Liability.
1. Liability for loss, delay or damage to Baggage is limited under the provisions of Carriage by Air Act, 1972 and the rules framed thereunder with certain exceptions, adaptations, modifications etc. as notified by the Ministry of Civil Aviation, Government of India, and as amended from time to time.
2. Zoom Air will not be liable for damage to Hand Baggage unless such damage is caused by Zoom Air's negligence.
3. The Passenger shall be responsible for any damage caused by the Passenger's Baggage to other persons or property, including Zoom Air's property and Zoom Air will not be liable to any third person for any damage caused by the Passenger's Baggage.
4. Zoom Air shall have no liability what so ever for damage to articles not permitted to be contained in Checked Baggage as per the provisions of these Terms & Conditions (including, without limitation, fragile or perishable items, items having a special value, such as currency, jewellery, precious metals, computers, personal electronic devices, negotiable papers, securities, or other valuables, business documents, passports and other identification documents).
5. Zoom Air will not be liable for any damage arising from Zoom Air's compliance with applicable laws or Government rules and regulations or from the Passengers' failure to comply with the same.
6. Zoom Air's liability for loss or damage to Baggage is limited to Rs.200 per kg only, maximum Rs 3000. Zoom Air assumes no liability for fragile or perishable articles.
7. The contract of carriage, including these Terms & Conditions and exclusions or limits of liability, applies to our Travel Partners, servants, employees and representatives to the same extent as it and they apply to Zoom Air. The total amount recoverable from Zoom Air and from such Travel Partners, employees, representatives and persons shall not exceed the amount of Zoom Air's own liability, if any.

Claims.
Acceptance of Baggage by the bearer of the Baggage (Identification) Tag without complaint at the time of delivery is sufficient evidence that the Baggage has been delivered in good condition and in accordance with the contract of carriage. Unless the Passenger proves otherwise no claims shall be entertained by Zoom Air.

Limitation.
Any right to damages shall be extinguished if an action is not brought against Zoom Air at the arrival on the destination, or the date on which the aircraft was scheduled to arrive, or the date on which the carriage stopped. The method of calculating the period of limitation shall be determined by law of the court where the case is heard.

Governing law and dispute settlement mechanism

Governing Law .
These Terms & Conditions shall be construed by, and governed in accordance with Indian Laws


Dispute Settlement Mechanism.
All disputes arising out of, or in connection with these Terms & Conditions shall be settled by the Court of Delhi Jurisdiction, India, which shall have exclusive jurisdiction to hear the matters in relation to these Terms & Conditions
